Terms of service

These terms are an agreement between you and EverBeside Co. (“EverBeside”, “we”), 1211 SW 5th Ave, Portland, OR 97204. By using everbeside.co you agree to them. We've tried to keep them short and plain.

What we do

EverBeside creates AI-generated portraits from photos you upload. Portraits are artistic images made by an AI model. They are not photographs of real events, and results vary. You can preview your first 3 looks free before deciding to buy.

Your photos and your permission

• Only upload photos you took, or that you have permission to use, of people who agree to be included.
• You must be 18 or older. Do not upload photos of anyone under 18 unless you are their parent or legal guardian.
• Do not upload anything unlawful, sexual, violent, hateful, or intended to deceive, harass or impersonate. We screen uploads automatically and may refuse or delete them.
• You keep all rights in your photos. You give us a limited licence to process them only to make, deliver and support your portraits.

Your portraits

Once you pay, the portraits are yours to download, print, share and use for any personal, non-commercial purpose, including gifts and social media. Free previews are watermarked and for evaluation only. Please don't use portraits to mislead anyone into thinking an event really happened.

Prices and payment

Prices are shown before you pay: currently $19 for your first portrait in a session, $10 for each additional portrait, and the third portrait in a session free. Purchases are one-time; there is no subscription. Payment is handled by Stripe. Prices are in US dollars and may include applicable taxes.

Refunds and our promise

If a portrait is still clearly wrong (for example, it doesn't resemble the people or pets in your photos, has an obvious defect like extra limbs, or is missing someone), email [email protected] within 14 days of delivery and we'll fix it or refund that portrait in full. Because you see a preview before buying, we can't refund a portrait that came out as previewed simply because you changed your mind. If we can't produce your order at all, we refund it automatically.

Gifts

If you send a gift, you confirm you have permission to use the photos and the recipient's email address. We email the recipient once, on the date you choose, and won't market to them unless they sign up themselves.

Rewards and partners

Referral rewards are for genuine personal recommendations. Self-referrals, fake accounts or paid ads on our brand name aren't allowed, and we may withdraw rewards earned that way. Partner (affiliate) earnings are described on the partner page and paid weekly once a sale is 14 days old.

Liability

The service is provided as is. To the extent the law allows, our total liability for any claim is limited to what you paid us for the order concerned. Nothing here limits rights you have under consumer law that can't be excluded.
